Bookz Pro Terms and Conditions

Thank you for choosing One Start LLC (“Company,” “we,” “us,” or “our”). Before using our services, please read the following Terms of Service (“Agreement”) carefully. This Agreement governs your use of our services and sets forth the terms and conditions under which you may access and use our platform.

1. Acceptance of Terms

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must not access or use our services.

 2. Description of Services

One Start LLC provides B2B SaaS services that involve the collection of email addresses and phone numbers from individuals and businesses for legitimate business purposes.

3. Compliance with TCPA

a. By agreeing to these Terms of Service, you acknowledge that our services may involve the collection of email addresses and phone numbers, and that you are responsible for ensuring compliance with the Telephone Consumer Protection Act (TCPA), as well as any other applicable laws and regulations governing the use of such contact information.

b. You agree to use our services in strict accordance with the provisions of the TCPA, which include, but are not limited to, obtaining proper consent from individuals and businesses before sending them any commercial messages via email or text message, as defined by the TCPA.

c. You understand that “prior express written consent” is required under the TCPA for automated or prerecorded calls or messages sent to wireless numbers or for telemarketing purposes. You agree to obtain such consent from individuals and businesses in a clear and conspicuous manner.

d. You further acknowledge that it is your responsibility to maintain accurate and up-to-date records of the consents obtained from individuals and businesses, and to provide proof of such consents upon request.

e. You agree to comply with all other requirements of the TCPA, including honoring opt-out requests, maintaining a Do Not Call list if applicable, and other provisions that apply to your use of the collected contact information.

f. You agree to indemnify and hold harmless One Start LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses arising out of or related to your failure to comply with the TCPA or any other applicable laws or regulations.

4. User Obligations

a. You represent and warrant that you have the legal authority to agree to this Agreement on behalf of yourself or the entity you represent, and that you are at least 18 years old.

b. You agree to provide accurate and complete information during the sign-up process and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

c. You agree not to use our services for any illegal, unauthorized, or unethical purposes, including but not limited to sending unsolicited commercial messages or engaging in spamming activities.

5. Intellectual Property

You agree that One Start LLC owns all intellectual property rights in the Bookz Pro Services. Except as expressly stated herein for the Subscription Term, this Agreement does not grant you any rights to, or in, patents, copyrights, database rights, trade secrets, trade names, trademarks (whether registered or unregistered), or any other rights or licenses with respect to the Bookz Pro Services. You further agree that you will not: (a) attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any portion of the Bookz Pro Services in any form or media or by any means; (b) attempt to reverse compile, disassemble, emulate, reverse engineer or otherwise reduce to human-perceivable form all or any part of the Bookz Pro Services; or (c) access all or any part of the Bookz Pro Services in order to build a product or service which competes with the Bookz Pro Services.

6. Limitation of Liability

To the maximum extent permitted by applicable law, One Start LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.

7. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of [insert your jurisdiction]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in [insert your jurisdiction].

8. Modification of Terms

9. Disclaimer of All Warranties

YOU AGREE THAT YOUR USE OF THE BOOKZ PRO SERVICES SHALL BE AT YOUR SOLE RISK. THE BOOKZ PRO SERVICES AND ALL CONTENT THEREON ARE PROVIDED “AS IS”, “AS AVAILABLE” AND “WITH ALL FAULTS”. ONE START LLC EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. ONE START LLC MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF ANY INFORMATION FOUND IN THE BOOKZ PRO SERVICES. ONE START LLC ASSUMES NO LIABILITY OR RESPONSIBILITY TO YOU OR ANYONE ELSE FOR ANY (I) ERRORS, MISTAKES, INTERRUPTIONS OR INACCURACIES OF ANY INFORMATION OR CONTENT IN THE BOOKZ PRO SERVICES, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND/OR USE OF OR RELIANCE ON ANY INFORMATION FOUND IN THE BOOKZ PRO SERVICES, (III) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE BOOKZ PRO SERVICES BY ANY THIRD PARTY; AND/OR (IV) ANY INTERRUPTIONS IN THE BOOKZ PRO SERVICES OR THE NETWORK OR ANY TELECOMMUNICATIONS NETWORK. ONE START LLC DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY INFORMATION FOUND IN THE BOOKZ PRO SERVICES.

10. Entire Agreement

This Agreement constitutes the entire agreement between you and One Start LLC regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and representations, whether oral or written.
